License Grant<\/h2>\n\n\n\n<p>The <strong>Lumings<\/strong> software, a SketchUp plugin, is licensed, <strong>not sold<\/strong>, to the end user (&#8220;User&#8221;).<\/p>\n\n\n\n<p>The license allows the User to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>install the software on the number of seats purchased,<\/li>\n\n\n\n<li>use it for professional and\/or personal purposes,<\/li>\n\n\n\n<li>access features and projector database according to the chosen plan.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2. Restrictions<\/h3>\n\n\n\n<p>The User shall not:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>copy, modify, distribute, or resell the software or its components,<\/li>\n\n\n\n<li>perform reverse engineering, decompilation, or extraction of source code,<\/li>\n\n\n\n<li>transfer the license to any third party.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">3. License Term<\/h3>\n\n\n\n<p>The license is valid for the purchased subscription period (monthly or annual) and automatically expires at the end of the term, unless manually renewed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Support and Updates<\/h3>\n\n\n\n<p>Technical support is provided via the website contact form.<br>Updates are included for the duration of the license.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. Intellectual Property<\/h3>\n\n\n\n<p>All copyrights, trademarks, patents, and other intellectual property rights remain the exclusive property of the Seller (<strong>COSMO AV<\/strong>). The User acquires no ownership rights in the software.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. Limitation of Liability<\/h3>\n\n\n\n<p>The Seller shall not be liable for any indirect or consequential damages arising from the use of the software.<br>Liability is limited to the amount paid for the license.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. Termination<\/h3>\n\n\n\n<p>In case of violation of this agreement, the license may be terminated immediately without prejudice to the Seller&#8217;s rights.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8. Governing Law<\/h3>\n\n\n\n<p>This license is governed by French law. Any dispute shall fall under the exclusive jurisdiction of the courts of Paris, subject to any mandatory consumer protection laws applicable in the User\u2019s country of residence.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>FRENCH VERSION<\/summary>\n<h3 class=\"wp-block-heading\">1. Licence d&#8217;utilisation<\/h3>\n\n\n\n<p>Le logiciel <strong>Lumings<\/strong>, plugin pour SketchUp, est conc\u00e9d\u00e9 sous licence, <strong>non vendu<\/strong>, au Client final (ci-apr\u00e8s \u00ab l\u2019Utilisateur \u00bb).<\/p>\n\n\n\n<p>La licence permet :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>l&#8217;installation sur le nombre de postes correspondant aux si\u00e8ges achet\u00e9s,<\/li>\n\n\n\n<li>l&#8217;utilisation \u00e0 des fins professionnelles et\/ou personnelles,<\/li>\n\n\n\n<li>l&#8217;acc\u00e8s aux fonctionnalit\u00e9s et \u00e0 la base de donn\u00e9es de projecteurs selon le produit souscrit.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2. Restrictions<\/h3>\n\n\n\n<p>L&#8217;Utilisateur s&#8217;engage \u00e0 ne pas :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>copier, modifier, distribuer ou revendre le logiciel ou ses composants,<\/li>\n\n\n\n<li>r\u00e9aliser toute r\u00e9tro-ing\u00e9nierie, d\u00e9compilation ou extraction du code source,<\/li>\n\n\n\n<li>transf\u00e9rer la licence \u00e0 un tiers.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">3. Dur\u00e9e de la licence<\/h3>\n\n\n\n<p>La licence est valable pour la p\u00e9riode d\u2019abonnement achet\u00e9e (mensuelle ou annuelle) et expire automatiquement \u00e0 la fin de cette p\u00e9riode, sauf renouvellement manuel.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Support et mises \u00e0 jour<\/h3>\n\n\n\n<p>Le support technique est fourni via le formulaire de contact du site.<br>Les mises \u00e0 jour sont incluses pour toute la dur\u00e9e de validit\u00e9 de la licence.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. Propri\u00e9t\u00e9 intellectuelle<\/h3>\n\n\n\n<p>Tous les droits d&#8217;auteur, marques, brevets et autres droits de propri\u00e9t\u00e9 intellectuelle restent la propri\u00e9t\u00e9 exclusive du Vendeur (<strong>COSMO AV<\/strong>). L&#8217;Utilisateur n&#8217;acquiert aucun droit de propri\u00e9t\u00e9 sur le logiciel.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. Limitation de responsabilit\u00e9<\/h3>\n\n\n\n<p>Le Vendeur ne pourra \u00eatre tenu responsable des dommages indirects ou immat\u00e9riels r\u00e9sultant de l&#8217;utilisation du logiciel.<br>La responsabilit\u00e9 est limit\u00e9e au montant pay\u00e9 pour la licence.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. R\u00e9siliation<\/h3>\n\n\n\n<p>En cas de violation des pr\u00e9sentes conditions, la licence pourra \u00eatre r\u00e9sili\u00e9e imm\u00e9diatement, sans pr\u00e9judice des droits du Vendeur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8. Droit applicable<\/h3>\n\n\n\n<p>La licence est r\u00e9gie par le droit fran\u00e7ais.
