Seller identification<\/h3>\n\n\n\n<p>These Terms and Conditions are entered into between:<\/p>\n\n\n\n<p><strong>COSMO AV<\/strong>, a simplified joint\u2011stock company (SAS)<br>Registered office: 11 rue Maurice Grandcoing, 94200 Ivry\u2011sur\u2011Seine, France<br>SIRET: 448 531 665 00033<br>VAT number: FR46 448531665<br>Contact email: <a>contact@lumings.io<\/a><\/p>\n\n\n\n<p>(hereinafter referred to as \u201cthe Seller\u201d)<\/p>\n\n\n\n<p>and any individual or legal entity placing an order via the website (hereinafter \u201cthe Customer\u201d).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">2. Purpose<\/h3>\n\n\n\n<p>These Terms and Conditions govern the sale of <strong>Lumings software licenses<\/strong>, a SketchUp plugin for <strong>3D video projection simulation<\/strong>, including access to a projector database depending on the selected plan.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">3. Products<\/h3>\n\n\n\n<p>Lumings is provided as a <strong>digital software activation license<\/strong>.<\/p>\n\n\n\n<p>The essential characteristics (subscription duration, database scope, number of seats) are specified on the product page at the time of purchase.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">4. License terms<\/h3>\n\n\n\n<p>The license granted is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Per workstation<\/strong>,<\/li>\n\n\n\n<li>Valid for the <strong>number of seats purchased<\/strong>,<\/li>\n\n\n\n<li>Usable for professional and\/or personal purposes.<\/li>\n<\/ul>\n\n\n\n<p>The license is personal and <strong>non\u2011transferable<\/strong>.<\/p>\n\n\n\n<p>Any reverse engineering, unauthorized reproduction, distribution or resale is strictly prohibited.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">5. Duration and subscriptions<\/h3>\n\n\n\n<p>License duration depends on the selected product.<\/p>\n\n\n\n<p>Subscriptions <strong>do not renew automatically<\/strong>. Renewal must be initiated manually by the Customer.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">6. Prices<\/h3>\n\n\n\n<p>Prices are displayed <strong>exclusive of taxes (excl. VAT)<\/strong>.<\/p>\n\n\n\n<p>VAT is applied in accordance with applicable French and EU regulations.<\/p>\n\n\n\n<p>The Seller reserves the right to modify prices at any time without retroactive effect.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">7. Payment<\/h3>\n\n\n\n<p>Payment is due in full at the time of order.<\/p>\n\n\n\n<p>Accepted payment method:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>PayPal<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Other payment methods may be accepted upon prior request.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">8. Digital delivery<\/h3>\n\n\n\n<p>Delivery consists of the <strong>electronic transmission of the license key<\/strong>.<\/p>\n\n\n\n<p>Delivery is immediate after payment validation.<\/p>\n\n\n\n<p>If the license is not received within 10 minutes, the Customer must contact support. The license will be resent after verification.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">9. Right of withdrawal<\/h3>\n\n\n\n<p>In accordance with Article 16(m) of Directive 2011\/83\/EU, the right of withdrawal does not apply to digital content supplied immediately after purchase.<\/p>\n\n\n\n<p>By placing an order, the Customer expressly waives the right of withdrawal.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">10. Support and updates<\/h3>\n\n\n\n<p>Customer support is available via the website contact form.<\/p>\n\n\n\n<p>Software updates are included for the entire duration of the subscription.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">11. Liability<\/h3>\n\n\n\n<p>The Seller shall not be liable for indirect damages resulting from the use of the software.<\/p>\n\n\n\n<p>In all cases, liability is limited to the amount paid for the relevant license.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">12. Personal data (GDPR)<\/h3>\n\n\n\n<p>Personal data is collected solely for order processing, license management and customer support.<\/p>\n\n\n\n<p>In accordance with GDPR, Customers have the right to access, rectify, erase or object to the processing of their data.<\/p>\n\n\n\n<p>Requests may be sent to: <a>contact@lumings.io<\/a><\/p>\n\n\n\n<p>No personal data is sold or transferred to third parties.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">13. Objet<\/h3>\n\n\n\n<p>Les pr\u00e9sentes CGV ont pour objet de d\u00e9finir les conditions dans lesquelles le Vendeur commercialise des <strong>licences d\u2019activation du logiciel Lumings<\/strong>, plugin pour SketchUp, permettant la <strong>simulation de vid\u00e9oprojection 3D<\/strong>, incluant l\u2019acc\u00e8s \u00e0 une base de donn\u00e9es de projecteurs selon la formule choisie.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">3. Produits<\/h3>\n\n\n\n<p>Le logiciel <strong>Lumings<\/strong> est fourni sous forme de <strong>licence logicielle d\u00e9mat\u00e9rialis\u00e9e<\/strong>, accessible apr\u00e8s activation.<\/p>\n\n\n\n<p>Les caract\u00e9ristiques essentielles (dur\u00e9e d\u2019abonnement, \u00e9tendue de la base de donn\u00e9es, nombre de si\u00e8ges) sont pr\u00e9cis\u00e9es sur la page produit au moment de la commande.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">4. Licence d\u2019utilisation<\/h3>\n\n\n\n<p>La licence conc\u00e9d\u00e9e est :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Par poste<\/strong>,<\/li>\n\n\n\n<li>Valable pour le <strong>nombre de si\u00e8ges achet\u00e9s<\/strong>,<\/li>\n\n\n\n<li>Utilisable \u00e0 des fins professionnelles et\/ou personnelles.<\/li>\n<\/ul>\n\n\n\n<p>La licence est strictement personnelle au Client et <strong>non transf\u00e9rable<\/strong>.<\/p>\n\n\n\n<p>Il est strictement interdit :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>toute tentative de r\u00e9tro\u2011ing\u00e9nierie,<\/li>\n\n\n\n<li>toute reproduction, distribution ou revente non autoris\u00e9e du logiciel.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">5. Dur\u00e9e et abonnements<\/h3>\n\n\n\n<p>La dur\u00e9e de validit\u00e9 de la licence d\u00e9pend du produit souscrit (mensuel, annuel ou autre dur\u00e9e sp\u00e9cifi\u00e9e).<\/p>\n\n\n\n<p>Les abonnements <strong>ne sont pas renouvel\u00e9s automatiquement<\/strong>. Le Client devra proc\u00e9der manuellement \u00e0 tout renouvellement.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">6. Prix<\/h3>\n\n\n\n<p>Les prix sont indiqu\u00e9s en <strong>hors taxes (HT)<\/strong>.<\/p>\n\n\n\n<p>La TVA est appliqu\u00e9e conform\u00e9ment \u00e0 la l\u00e9gislation fran\u00e7aise en vigueur, notamment pour les achats effectu\u00e9s depuis la France.<\/p>\n\n\n\n<p>Le Vendeur se r\u00e9serve le droit de modifier ses prix \u00e0 tout moment, sans effet r\u00e9troactif.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">7. Paiement<\/h3>\n\n\n\n<p>Le paiement est exigible <strong>en totalit\u00e9 au moment de la commande<\/strong>.<\/p>\n\n\n\n<p>Les moyens de paiement accept\u00e9s sont :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>PayPal<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Tout autre moyen de paiement pourra \u00eatre envisag\u00e9 sur demande pr\u00e9alable.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">8. Livraison<\/h3>\n\n\n\n<p>La livraison consiste en l\u2019envoi <strong>\u00e9lectronique<\/strong> de la cl\u00e9 de licence.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>D\u00e9lai : instantan\u00e9 apr\u00e8s validation du paiement<\/li>\n\n\n\n<li>Si la licence n\u2019est pas re\u00e7ue dans un d\u00e9lai sup\u00e9rieur \u00e0 10 minutes, le Client est invit\u00e9 \u00e0 contacter le support.<\/li>\n<\/ul>\n\n\n\n<p>En cas de non\u2011r\u00e9ception de l\u2019email, le Vendeur renverra la cl\u00e9 de licence apr\u00e8s v\u00e9rification.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">9. Droit de r\u00e9tractation<\/h3>\n\n\n\n<p>Conform\u00e9ment \u00e0 l\u2019article L221\u201128 du Code de la consommation, le droit de r\u00e9tractation est <strong>exclu<\/strong> pour les contenus num\u00e9riques fournis imm\u00e9diatement apr\u00e8s paiement et dont l\u2019ex\u00e9cution a commenc\u00e9 avec l\u2019accord du Client.<\/p>\n\n\n\n<p>En validant sa commande, le Client reconna\u00eet renoncer express\u00e9ment \u00e0 son droit de r\u00e9tractation.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">10. Support et mises \u00e0 jour<\/h3>\n\n\n\n<p>Un support client est disponible via le <strong>formulaire de contact du site<\/strong>.<\/p>\n\n\n\n<p>Les r\u00e9ponses sont apport\u00e9es par email.<\/p>\n\n\n\n<p>Les mises \u00e0 jour du logiciel sont incluses pendant toute la dur\u00e9e de validit\u00e9 de l\u2019abonnement.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">11. Responsabilit\u00e9<\/h3>\n\n\n\n<p>Le Vendeur ne saurait \u00eatre tenu responsable des dommages indirects r\u00e9sultant de l\u2019utilisation du logiciel.<\/p>\n\n\n\n<p>La responsabilit\u00e9 du Vendeur est en tout \u00e9tat de cause limit\u00e9e au montant pay\u00e9 par le Client pour la licence concern\u00e9e.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">12. Donn\u00e9es personnelles (RGPD)<\/h3>\n\n\n\n<p>Les donn\u00e9es personnelles collect\u00e9es sont strictement n\u00e9cessaires \u00e0 la gestion des commandes, des licences et du support client.<\/p>\n\n\n\n<p>Conform\u00e9ment au R\u00e8glement (UE) 2016\/679 (RGPD), le Client dispose d\u2019un droit d\u2019acc\u00e8s, de rectification, d\u2019opposition, de limitation et de suppression de ses donn\u00e9es.<\/p>\n\n\n\n<p>Toute demande peut \u00eatre adress\u00e9e \u00e0 : <a>contact@lumings.io<\/a><\/p>\n\n\n\n<p>Aucune donn\u00e9e n\u2019est vendue ou c\u00e9d\u00e9e \u00e0 des tiers.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">13.
