End User License Agreement

1. License Grant

The Lumings software, a SketchUp plugin, is licensed, not sold, to the end user (“User”).

The license allows the User to:

  • install the software on the number of seats purchased,
  • use it for professional and/or personal purposes,
  • access features and projector database according to the chosen plan.

2. Restrictions

The User shall not:

  • copy, modify, distribute, or resell the software or its components,
  • perform reverse engineering, decompilation, or extraction of source code,
  • transfer the license to any third party.

3. License Term

The license is valid for the purchased subscription period (monthly or annual) and automatically expires at the end of the term, unless manually renewed.

4. Support and Updates

Technical support is provided via the website contact form.
Updates are included for the duration of the license.

5. Intellectual Property

All copyrights, trademarks, patents, and other intellectual property rights remain the exclusive property of the Seller (COSMO AV). The User acquires no ownership rights in the software.

6. Limitation of Liability

The Seller shall not be liable for any indirect or consequential damages arising from the use of the software.
Liability is limited to the amount paid for the license.

7. Termination

In case of violation of this agreement, the license may be terminated immediately without prejudice to the Seller’s rights.

8. Governing Law

This license is governed by French law. Any dispute shall fall under the exclusive jurisdiction of the courts of Paris, subject to any mandatory consumer protection laws applicable in the User’s country of residence.

FRENCH VERSION

1. Licence d’utilisation

Le logiciel Lumings, plugin pour SketchUp, est concédé sous licence, non vendu, au Client final (ci-après « l’Utilisateur »).

La licence permet :

  • l’installation sur le nombre de postes correspondant aux sièges achetés,
  • l’utilisation à des fins professionnelles et/ou personnelles,
  • l’accès aux fonctionnalités et à la base de données de projecteurs selon le produit souscrit.

2. Restrictions

L’Utilisateur s’engage à ne pas :

  • copier, modifier, distribuer ou revendre le logiciel ou ses composants,
  • réaliser toute rétro-ingénierie, décompilation ou extraction du code source,
  • transférer la licence à un tiers.

3. Durée de la licence

La licence est valable pour la période d’abonnement achetée (mensuelle ou annuelle) et expire automatiquement à la fin de cette période, sauf renouvellement manuel.

4. Support et mises à jour

Le support technique est fourni via le formulaire de contact du site.
Les mises à jour sont incluses pour toute la durée de validité de la licence.

5. Propriété intellectuelle

Tous les droits d’auteur, marques, brevets et autres droits de propriété intellectuelle restent la propriété exclusive du Vendeur (COSMO AV). L’Utilisateur n’acquiert aucun droit de propriété sur le logiciel.

6. Limitation de responsabilité

Le Vendeur ne pourra être tenu responsable des dommages indirects ou immatériels résultant de l’utilisation du logiciel.
La responsabilité est limitée au montant payé pour la licence.

7. Résiliation

En cas de violation des présentes conditions, la licence pourra être résiliée immédiatement, sans préjudice des droits du Vendeur.

8. Droit applicable

La licence est régie par le droit français. Toute contestation sera soumise aux tribunaux compétents de Paris, sous réserve des dispositions impératives applicables au consommateur selon son pays de résidence.
